RealFeed Terms of Service and Data Processing Agreement

1. Acceptance of Terms

By installing, accessing or using RealFeed, you (the “Merchant”) agree to these Terms on behalf of the Shopify store on which RealFeed is installed. If you do not agree, do not install or use RealFeed, and uninstall it through your Shopify admin. If you are accepting these Terms for a business, you confirm you are authorized to do so.

2. Description of RealFeed

RealFeed is a Shopify app that provides storefront activity and social-proof functionality. It reads a limited set of order and product information from your Shopify store and uses it to generate short activity messages — for example, that a product was recently purchased — for display on your storefront. The specific information RealFeed processes, and the purposes for which it is processed, are described in the RealFeed Privacy Policy.

3. Shopify Account and Authorization

RealFeed operates through the Shopify platform and functions only for as long as it is installed on your store. When you install RealFeed, you authorize it to access your store using the Shopify access scopes the app requests — currently read_orders and read_products. RealFeed does not request write access to store data.

Your Shopify account and store remain yours. VirtueNest does not own, control or administer your Shopify account, and your relationship with Shopify is governed by your agreement with Shopify. You may revoke RealFeed’s access at any time by uninstalling the app.

4. Merchant Responsibilities

As a Merchant, you are responsible for:

• operating your Shopify store lawfully;
• the accuracy of your product and order data, and of any storefront content derived from it;
• providing the privacy notices required under the laws applicable to your customers, including disclosure of RealFeed’s processing where required;
• obtaining customer consent where applicable law or your store’s privacy configuration requires it;
• configuring RealFeed appropriately for your store, including its display and retention settings;
• complying with the laws that apply to your storefront and your customers.

5. Acceptable Use

You agree not to:

• use RealFeed for any unlawful purpose;
• attempt to bypass, disable or probe the app’s security or access controls, or access data belonging to another store;
• interfere with the operation of the app or its infrastructure, for example by placing an abnormal or automated load on it;
• use RealFeed to display activity messages that are false or fabricated, or that would otherwise mislead shoppers about activity in your store;
• install or use RealFeed on a store you do not own or are not authorized to manage.

6. Availability and Changes

We work to keep RealFeed available and reliable, but we do not guarantee uninterrupted or error-free operation. RealFeed depends on the Shopify platform and on third-party infrastructure, and may be affected by maintenance, outages or changes outside our control.

We may add, modify, improve or discontinue features of RealFeed where appropriate — for example to fix defects, improve performance, or meet platform or legal requirements. Where a change materially reduces core functionality you rely on, we will make reasonable efforts to communicate it.

7. Fees and Billing

Any charges for RealFeed are presented to you for approval in your Shopify admin before they apply, and are billed through Shopify’s billing system on your Shopify invoice. The current pricing, plans and any free tier or trial are those shown on the RealFeed Shopify App Store listing and in the app at the time you approve a charge.

VirtueNest does not collect or store your payment card details. Cancellation and refund handling follow Shopify’s billing behavior for app charges; uninstalling the app stops future charges in accordance with Shopify’s billing rules.

8. Intellectual Property

RealFeed, including its software, design, documentation and the RealFeed and VirtueNest names and branding, remains the property of VirtueNest and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use RealFeed on your Shopify store while it is installed and while you comply with these Terms. No other rights are granted.

You retain ownership of and control over your store data, including your product, order and customer data. We claim no ownership of it, and we use it only as described in these Terms and the RealFeed Privacy Policy.

9. Termination

You may stop using RealFeed at any time by uninstalling it through your Shopify admin. Uninstalling revokes the app’s access to your store, and RealFeed’s storefront functionality stops.

We may suspend or end access where these Terms are materially breached, where required by Shopify or by law, or where continued operation would create a security or legal risk.

After uninstall or termination, deletion and privacy processing continue as described in the RealFeed Privacy Policy and in Section 10.9 below.

10. Data Processing Agreement

This Section 10 forms a data processing agreement between the Merchant and VirtueNest in respect of personal data originating from the Merchant’s Shopify store that RealFeed processes. It applies to the extent data protection law applies to that processing, and it forms part of these Terms.

10.1 Roles

To the extent applicable under data protection law, the Merchant is the data controller (or equivalent, such as “business”) for personal data originating from the Merchant’s Shopify store, and VirtueNest acts as the data processor (or equivalent, such as “service provider”) when processing that data solely to provide RealFeed. These roles are described as they generally apply; the precise characterization may differ between jurisdictions.

10.2 Processing Instructions

VirtueNest processes that personal data only:

• on the Merchant’s documented instructions — which include the instructions expressed through the Merchant’s installation, configuration and use of RealFeed;
• as necessary to provide, operate and support RealFeed; and
• as required by applicable law or by our obligations as a Shopify platform partner.

10.3 Purpose Limitation

RealFeed does not use Shopify order or customer information for unrelated advertising, for the sale of personal data, or for cross-store customer profiling. We do not sell customer personal information.

10.4 Data Minimization

RealFeed limits processing to the data described in the RealFeed Privacy Policy and required for RealFeed’s functionality — in summary, per applicable order or line item: the Shopify order identifier, order creation time, product ID, product handle and title, item quantity, and the coarse location values city, province/state code and country code.

RealFeed does not intentionally request, process or store customer names, email addresses, phone numbers, Shopify customer IDs, street address or address line 2, postal/ZIP codes, or latitude and longitude, and it does not display direct customer-identifying fields to storefront shoppers.

10.5 Confidentiality and Access

Access to RealFeed production data is limited to personnel and service providers who need it to operate, support or secure RealFeed, and who are subject to appropriate confidentiality obligations.

10.6 Security Measures

We maintain technical and organizational safeguards designed to protect the data RealFeed processes, including:

• encrypted HTTPS/TLS connections for data in transit;
• access controls limiting who can reach production systems and data;
• verification of the authenticity of incoming Shopify webhook requests;
• reasonable operational safeguards, including scoped credentials and limiting the data the app requests to what it needs.

No method of transmission or storage is completely secure. We do not claim that all data is encrypted at rest across every RealFeed storage surface, and we hold no security or privacy certification — we make no claim of SOC 2, ISO 27001, HIPAA, PCI DSS or GDPR certification.

10.7 Sub-processors

VirtueNest may engage service providers (sub-processors) as necessary to operate RealFeed. Each is engaged only for the operation of the service, processes data only as needed for that purpose, and is expected to protect the data appropriately. The current sub-processors are:

• Shopify — The platform RealFeed runs on and the source of the order and product information RealFeed processes.
• MongoDB Atlas — Managed database hosting for RealFeed activity records and app configuration.
• Amazon Web Services (AWS Lightsail) — Hosting for the RealFeed application servers.

10.8 Data Subject Requests

We will provide reasonable assistance to Merchants in responding to applicable data-subject requests relating to data RealFeed processes, using Shopify’s privacy and compliance mechanisms. RealFeed processes the Shopify privacy webhooks for customer data requests (customers/data_request), customer redaction (customers/redact) and shop redaction (shop/redact), as described in the RealFeed Privacy Policy. Merchants may also contact us directly using the details in Section 16.

10.9 Deletion and Return

RealFeed activity records carry an expiry time and are removed once it passes; the default retention period is 90 days, and a merchant-configured period cannot exceed the maximum the application supports. A Shopify redaction request may cause records to be deleted earlier than their expiry.

Uninstall or termination does not override the limited retention of records that must legitimately be kept as short-term compliance evidence where applicable. We do not guarantee instantaneous deletion of every record at the moment of uninstall.

10.10 International Processing

The service providers named in Section 10.7 may process data in the locations where their infrastructure is operated, which may be outside the Merchant’s or the customer’s country. Such processing is subject to applicable legal requirements, and to contractual safeguards where those are required by law.

10.11 Compliance Assistance

We will provide, on reasonable request, the information a Merchant needs to understand RealFeed’s processing practices and to meet the Merchant’s own applicable privacy obligations — including the categories of data processed, the purposes of processing, retention, and sub-processors. This does not include a right to audit our systems or premises, and nothing here is legal advice.

11. Privacy

The RealFeed Privacy Policy — available at https://virtuenest.com/realfeed/privacy-policy — describes the information RealFeed processes, why it processes it, what it does not collect, retention, and how Shopify privacy requests are handled. It forms part of these Terms and is incorporated into them by reference.

12. Disclaimers

RealFeed is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that RealFeed will be uninterrupted or error-free, or that it will produce any particular commercial result, conversion rate or increase in sales.

RealFeed is an independent product. It is not affiliated with, endorsed by, or sponsored by Shopify or any other third party referenced in these Terms.

13. Limitation of Liability

To the maximum extent permitted by law, VirtueNest is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost revenue or lost data, arising from your use of RealFeed.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Indemnity

You agree to indemnify and hold VirtueNest harmless from third-party claims arising out of your unlawful operation of your store, your breach of these Terms, or your failure to provide the privacy notices or obtain the consents described in Section 4, except to the extent the claim arises from our own breach of these Terms.

15. Changes to These Terms

We may update these Terms from time to time — for example, if RealFeed’s functionality changes or to reflect legal or platform requirements. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of RealFeed after an update takes effect constitutes acceptance of the updated Terms.
